Terms of Service

These Terms of Service ("Terms") form a binding agreement between you ("User", "you") and AttireSnap ("Company", "we", "us") governing your access to and use of AttireSnap.com and all associated services, APIs, and mobile applications (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms in full. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old to create an account and use the Service. By using AttireSnap, you represent that you are of legal age and have the legal capacity to enter into this agreement. If you are using the Service on behalf of a business, you represent that you have the authority to bind that business to these Terms.

2. Your account

• You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
• You must not share your login details, API keys, or account access with any third party.
• You must notify us immediately at hello@AttireSnap.com if you suspect any unauthorised use of your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

3. Your content and IP

You retain full ownership of the product images you upload ("Input Content") and the AI-generated images produced from them ("Output Content"). By uploading Input Content, you grant AttireSnap a limited, non-exclusive, royalty-free licence to process, store, and transmit that content solely for the purpose of providing the Service.

• Paid plans: Output Content is licensed to you for unlimited commercial use.
• Free plan: Output Content may be used for personal and non-commercial purposes only.
• We do not claim ownership of your content, and we do not train our AI models on your Input Content or Output Content without your explicit opt-in consent.

4. Acceptable use

Your use of the Service is governed by our Acceptable Use Policy, which is incorporated into these Terms by reference. You must not use the Service to generate images of real, identifiable people without their consent, create misleading product representations, infringe third-party intellectual property, or engage in any unlawful activity.

5. Plans, billing, and refunds

• Paid plans are billed monthly as selected at checkout. Plans renew automatically at the end of each billing cycle.
• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing cycle; you retain access until that date. No refund is issued for the remaining unused period.
• All subscription fees and credit pack purchases are non-refundable except in cases of verified duplicate charges or confirmed technical failures on our end, as described in our Refund Policy.
• AttireSnap is an AI software service. Dissatisfaction with AI-generated output quality, change of mind, or reduced usage does not constitute grounds for a refund.
• Prices are in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise. We reserve the right to change pricing with 30 days' notice.

6. AI-generated content disclaimer

Output Content is generated by AI and may contain inaccuracies, artefacts, or unexpected results. AI-generated images do not constitute a guarantee of product appearance. You are responsible for reviewing all outputs before commercial use. See our Privacy Policy for details.

7. Intellectual property of the Service

All technology, software, designs, algorithms, and content comprising the AttireSnap platform (excluding your Input and Output Content) are owned by or licensed to AttireSnap and are protected by intellectual property law. You may not copy, reverse-engineer, decompile, or create derivative works from any part of the Service.

8. Limitation of liability

To the maximum extent permitted by applicable law, AttireSnap will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of profits, data, or business opportunities. Our total liability to you for any claim arising out of or relating to these Terms shall not exceed the total amount you paid to us in the 3 months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless AttireSnap, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your Input Content, or your violation of these Terms or any applicable law.

10. Termination

Either party may terminate the agreement at any time. We may suspend or terminate your account immediately if you violate these Terms, our Acceptable Use Policy, or any applicable law. Upon termination, your right to access the Service ceases immediately. We will retain your data for 30 days after termination to allow for data export, after which it will be deleted in accordance with our Privacy Policy.

11. Governing law and disputes

These Terms are governed by the laws of the Republic of India, without regard to its conflict-of-law provisions. Any dispute arising from or relating to these Terms shall first be attempted to be resolved through good-faith negotiation within 30 days of written notice. If not resolved, disputes shall be subject to the exclusive jurisdiction of the courts of competent jurisdiction in Surat, Gujarat, India, and both parties irrevocably submit to that jurisdiction.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified to registered users by email at least 14 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.

14. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. AttireSnap DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT AI-GENERATED OUTPUTS WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

15. Force majeure

AttireSnap shall not be liable for any failure or delay in performance of its obligations under these Terms to the extent caused by circumstances beyond its reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, flood, earthquake, epidemic or pandemic, fibre cuts, power failures, internet outages, or actions of third-party AI infrastructure providers. The affected party shall promptly notify the other and shall use commercially reasonable efforts to resume performance.

16. General provisions

• Severability. If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity or enforceability of the remaining provisions.
• Waiver. Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision. Any waiver must be in writing and signed by an authorised representative of AttireSnap to be effective.
• Entire agreement. These Terms, together with the Privacy Policy, Acceptable Use Policy, Refund Policy, DMCA Policy, and Cookie Policy, constitute the entire agreement between you and AttireSnap with respect to the Service and supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written.
• Assignment. You may not assign or transfer these Terms or any rights hereunder without our prior written consent. AttireSnap may assign these Terms in connection with a merger, acquisition, or sale of all or substantially all of its assets.
• No third-party beneficiaries. These Terms do not create any third-party beneficiary rights.
• Notices. All legal notices to AttireSnap must be sent in writing to legal@AttireSnap.com.
